The new amendment would stipulate: "Marriages, whether created by common law, contracted, or performed outside of North Carolina, between individuals of the same gender are not valid in North Carolina".

These both, in turn, follow the example set by Tennessee and Arkansas - which have "preemption" laws that prohibit cities from protecting any class from discrimination that isn't already protected under state law, which amounts to a de facto ban on LGBT protections.

"This action is about a great deal more than bathrooms", Lynch said at the time, drawing on images of racially segregated bathrooms before the civil rights era.

Texas plans to consider a new heinous "bathroom bill" next week that mimics the sham HB2 "repeal" approved by lawmakers in North Carolina recently which essentially left discrimination in place. "If we don't do this, we are discriminating against people of faith", he said, referring to clerks, judges, justices of the peace and other elected officials empowered to issue marriage licenses in Texas' 254 counties.

Despite criticism from LGBT advocates, the recent repeal of North Carolina's controversial "bathroom law" was enough for the NCAA to lift its boycott to return the championship events to the state. It bans local LGBTQ non-discrimination protections statewide through 2020, and it substitutes the previous anti-transgender bathroom provisions with a new provision that forbids state agencies, public universities, primary and secondary schools, and cities from adopting policies ensuring transgender people have access to restrooms consistent with their gender identity.

The suit, which includes claims for the damages inflicted by HB2, will continue, and legal-team members said they will seek to amend the lawsuit to challenge HB142 as well.

"This move does not affect the merits of the case", she said. HB 142 was unconstitutional the moment it was enacted. "Sadly, this was not unexpected, now that anti-transgender forces are in charge of the Departments of Justice and Education".

A California law went into effect in January barring state-funded travel or other spending in states with laws that discriminate against LGBT people.

Given the NCAA and National Basketball Association were convinced to abandon their boycotts of North Carolina over its replacement law, it seems likely that Texas lawmakers expect their new plan will similarly be safer from economic backlash.
