Shocking video of police shooting wasn't enough to convict

During The Tom Sullivan Show on Wednesday, Tom reacted to the graphic footage released yesterday that shows Philando Castile being shot by Minnesota police officer Jeronimo Yanez. The Minnesota Bureau of Criminal Apprehension released the case file four days after a Ramsey County jury acquitted Yanez of second-degree manslaughter and two felony counts of a risky discharge of a firearm.

The former St. Anthony officer said he believed Castile was reaching for a gun when he shot him. Both the dash-cam video of the incident as well as the video taken by Castile's girlfriend Diamond Reynolds do not seem to show a gun anywhere near Castile.

Hutchinson, who said he has a concealed-carry permit, also said the video left room for reasonable doubt, because it does not show where the gun was.

Yanez claimed that Philando's "wide set nose" and long hair fit the description of two male African-American robbery suspects from a convenience store sometime prior to the shooting, and said that he couldn't tell that Diamond was a woman sitting next to Castile in the front seat.

Members of the black community expressed their outrage at the jury's decision - and disgust at the video - on Twitter, while rights groups also spoke out.

But what happened outside the vehicle, before Officer Jeronimo Yanez pulled the trigger?

Last week, a jury found Yanez not guilty on all charges.

State Rep. Nick Zerwas (R-Elk River) called the video tough to watch, but added that the footage only reinforced how Yanez had a hard split-second situation to make and explained the jury's decision. The gunfire took place seconds after Castile told the officer, "Sir, I have to tell you, I do have a firearm on me".

"OK don't reach for it, then", Mr Yanez says. The in-squad camera video of Reynolds and her daughter waiting to be transported to the Roseville Police Department for questioning, was not shown at trial.

Taken from a distance, the dashboard video does not show what happened inside the vehicle during the crucial seven seconds from when Castile said he had a gun to when Yanez fired his final shot.

Video released by the BCA shows Yanez turn on his emergency lights, pull Castile over and approach Castile's vehicle.

Strawser said that in the aftermath of Castile's death, the Gun Owners Caucus sent letters to Governor Mark Dayton, Public Safety Commissioner Mona Dohman, the Minnesota Board of Peace Officers Standards and Training, and three major police trade associations in Minnesota. Reynolds responded. "I can't believe they just did that". I learned early in my career that if I could prove an officer was being untruthful or made an error during an investigation, I would be better off if I portrayed to the jury that the officer just made an honest mistake.

"I could keep you safe", she adds.

Prosecutors were not able to punch clear holes in Yanez's testimony on cross-examination. "Don't move! pop pop pop pop pop pop pop and took off", she said during the interview. Judge William Leary III ruled that it was too late. Yanez slowly walks away, and another officer says: "You all right?" He rejected that request because new evidence can not be admitted after a case goes to the jury.
