14-Year Old Video Game Cheater Sued, Mom Defends Him

Since Fortnite Battle Royale is a free-to-play video game, and Epic would need to provide a statement certifying that Rogers' cheating directly caused them a "mass profit loss" due to her son's actions.

Finally, the mother says that by releasing her son's name publicly in conjunction with the move that Epic has violated DE laws related to the release of information on minors. Well, it seems like Epic Games has shown the meaning of "Zero Tolerance" for anyone who is willing to cheat on their game. "Under these circumstances, the law requires that we file suit or drop the claim".

She adds that instead of going after the cheaters, Epic should be targeting sites that offer warez in the first place (a bit like going after the dealer, not the addict, really). "We take cheating seriously, and we'll pursue all available options to make sure our games are fun, fair, and competitive for players". Epic is not okay with ongoing cheating or copyright infringement from anyone at any age. The game involves a contest between a large number of human players, with as many as 100 people facing off in a single round.

Fortnite on Xbox One X pushes the game's visual settings comparable to what you'd see on a PC set to "Epic" quality. She acknowledged that her son showcased those cheats during a live stream session via YouTube. As it turns out, one of the two defendants is actually a 14-year-old boy, and his mom is livid that her son has been thrust into this legal three-ring circus. Epic makes a teenager "scapegoat", because it is not able to cope with cheaters.

The mother also alleges Epic is "using a 14-year-old child as a scape goat to make an example of him".

The authors of the game stated that using cheats leads to loss of funds. It's unclear the company even knew the boy's age at the time it filed suit.

The biggest point of contention revolves around the EULA agreement.

Rogue online gamers have designed, sold or used computer code to crush competitors playing the popular "Fortnite" survival video game, spoiling the experience and the creator's profit potential, the game's maker charges in a series of lawsuits. This week we're seeing a bunch of bug fixes while also a few new additions to the game itself. The boy's mother is calling on the court to dismiss the case as "the infraction does not equate the suing of a minor by a major gaming company". Cheating may be something developers have a legitimate interest in stamping out, but doing so by using their formidable resources to crush a 14-year-old would appear to be a step too far.
