Ezekiel Elliott's lawyers trying to settle with NFL

"It was a little rust; I'm not going to lie", Elliott said.

The next step in the ongoing legal saga surrounding Dallas Cowboys running back Ezekiel Elliott has been scheduled for Thursday when the U.S. Court of Appeals for the Second Circuit will hear oral arguments for an emergency injunction motion of Elliott's suspension. "So every day is worth fighting".

If the judges were to make a decision by Friday in which Elliott did not gain a preliminary injunction, then the suspension would start immediately and he would not play this week against the Atlanta Falcons. Elliott, who was not arrested or charged in the case, maintains his innocence after being accused of assaulting his former girlfriend in Columbus, Ohio. While the running back has yet to miss any of Dallas' eight games to date, that could change Thursday in the event the court rules to deny Elliott's appeal and reinstate the suspension, which federal judge Katherine Failla previously upheld in an October 30 hearing.

"We note that the issuance of an administrative stay does not constitute a resolution on the merits", Susan L. Carney, a judge on the 2nd Circuit, wrote in Friday's filing. Florio pointed out that Proskauer Rose isn't representing the NFL in the Elliott case, but the league is using the CBA as a basis for Elliott's suspension.

The NFL is unlikely to agree upon a settlement with Elliott.

Cowboys owner Jerry Jones said he "didn't have a thought" when asked what he thinks Elliott's chances are of winning in his battle against the NFL.
